WHAT IS ARTICLE 370?

Recently Article 370, was a buzz with the Indian Government. The Article below aims to simplify the meaning of Article 370 under Indian Constitution.

What does the Article signify?

Article 370 grants special autonomous status to the State of  Jammu and Kashmir (J&K).

Since the time of partition (between India and Pakistan), Article 370, introduced in the constitution of India, with the objective of giving space and autonomy (self-governance) to that government of the State feeling disconnected as a result of both countries fighting for the same State.

Therefore, the article safeguards the State of Jammu and Kashmir, allowing it to have its own constitution.

However, some issues still lie with the Indian Government, others matters are dealt by the State Government of Jammu & Kashmir.

For example, according to Article 370, except for defense, foreign affairs, finance and communications, the Parliament needs the agreement of J&K State government to apply any other law or laws.

Furthermore, the residents of Jammu & Kashmir, live under separate set of laws, including those related to citizenship, ownership of property, and fundamental rights, in comparison to other Indians. It prohibits Indian citizens from other States to purchase land or property in State of Jammu & Kashmir.

The Articles controversial significance and the thought of its repeal is questionable. What are the consequences that will then follow?

One can only hope to see what ruling the current Government takes. Hopefully, the debate on this Article brings about a favorable outcome for Jammu and Kashmir to India’s best interests.
