Code Of Criminal Procedure, 1973

Code of Criminal Procedure, 1973 came into force on  1st April, 1974. It also gives machinery for the investigation of crime,  harm of criminals, collection of evidence, determination of mens rea or  innocence of the accused and also the determination of punishment of the guilty. It also deals with public nuisance, prevention of offences and maintenance of wife, child and parents.

Code of criminal procedure is applicable to all criminal proceedings in India (except those in the States of Jammu and Kashmir and Nagaland the Tribal Areas in Assam). It extends to whole of India except Jammu and Kashmir and Nagaland. The central governments has also amended the Act from time to time. Two important amendments were of 1923 and 1955. The amendment of 1955 was extensive and intention was to simplify procedure and also facilitate speedy disposal trails. In addition, State amendments also brought about separation of judiciary power from executive one. Apart from these amendments, the provisions of the Code of 1898 have remained practically unchanged. No attempt was made to comprehensively change the old code till Central Law Commission was set up in 1955.

Amendment of section 20,  Amendment of section 24,  Insertion of new section 25A,  also Amendment of section 29, Insertion of new section 50A, Amendment of section 53 and also Insertion of new section 53A, Amendment of section 54, Insertion of new section 54A,  Amendment of section 82, Amendment of section 102 etc.

Amendment to section 195 of the Code of Criminal Procedure and also Insertion of new Chapter XXIA.

To minimize abuse of powers of arrest by police, which also being a cognizable offence didn’t need a warrant for arrest.  Section 41, 41A, and also 41B of Code of Criminal Procedure, 1973  amended related to arrest without warrant by police.

14. Code of Criminal Law (Amendment) Act, 2013

In the Code of Criminal Procedure, 1973, Following sections were amended : section 26, 54, 54A, 160, 161, 164, 173, 197, 198A, 275, 309, 327, 357A and also First schedule of the code.

15. Code Of Criminal Procedure ( Maharashtra Amendment) Act, 2015

Section 156 adds no Magistrate, order investigation against public a public servant in respect of discharging his official duty and also amends Section 190, no magistrate take cognizance of any offence committed by public servant while discharging their duty.
